A 49-year-old man has been sentenced today [Thursday 29 August] to nine years and three months in prison plus five years on extended license for attempted rape.
Kevin Foale, of Totnes, was sentenced by the judge after pleading guilty to the offence on day two of the trial at the beginning of July 2019.
The offence took place at around 2am on Sunday 20 January 2019 near The Terrace in Torquay.
The victim, a woman in hers 20s, was found by members of the public in a distressed state following the attack; they contacted emergency services and assisted at the scene.
She was taken to Torbay District Hospital where she received expert medical care and was supported by specialist officers.
Following further police CCTV enquiries, Foale was arrested by officers on Wednesday 23 January in Totnes. He was later charged with attempted rape and remanded to court.
A four day trial began on Monday 8 July and was scheduled for four days at Exeter Crown Court. On day two, Foale changed his plea to guilty and was remanded into custody for sentencing on Thursday 29 August.
