Pervert forced underage Derby girl to carry out sex acts on him

A pervert threatened an underage girl from Derby saying he would have full intercourse with her unless she carried out sex acts on him.

Derby Crown Court heard how Patrick Conlan and the victim were both under the age of 16 when the abuse took place more than 35 years ago.

When they were both at a house in Derby he would touch her sexually and make her carry out the acts on him.

The hearing was told how the woman kept quiet about what happened to her until Conlan, now 52, was jailed for gross indecency with a different underage girl in 2000.

On that occasion she told her sister but then kept the secret to herself again until 2016 when she went to the police.

Conlan, who the court was told has a number of previous child sex convictions to his name, was arrested and denied what took place more than three decades ago.

But he later pleaded guilty to carrying our the acts in Derby.

Judge Shaun Smith QC handed Conlan a three-month jail term, suspended for 18 months, explaining to the court that this would have been the maximum sentence the defendant would have received at the time of the offences should they have come to light then.

He said: “This in no way demeans the behaviour, but it is that sentence because these are my limited powers.

“Everyone is agreed, the prosecution, the defence and myself, that if you were being dealt with back then the court would not have been able to send you to custody for any longer than three months because of your age (at that time).

“The public can rest assured the authorities are still keeping an eye on you lest you be tempted to commit this type of behaviour again.

“You have not carried out any type of offence since you were last before the courts in 2008 and you have successfully completed all of the courses that were designed to help your rehabilitation.”

Jonathan Straw, prosecuting, said the offences took place more than 35 years ago.

He said at that time both she and Conlan were aged under 16 and that he would touch her sexually and make her carry out sex acts on him while making threats he would make her have full sex with him if she did not comply.

Mr Straw said: “Over the years there were various disclosures made.

She disclosed to her sister in 2000 when further allegations (on a different victim) came to light and he was sentenced for indecent assault on a female under the age of 14 and gross indecency with a child.

“That offence saw him sent to prison for two years and placed on the sex offender’s register for 10 years.

“In 2016 the (Derby) victim made disclosures to her partner about what happened to her and she went to the police.

“The defendant was arrested and interviewed in February 2017 and made denials as to what had happened.”

Conlan of Ebers Road, Sherwood, Nottingham, later pleaded guilty to sexual assault of a child.

No victim personal statement was read out to the court, but Mr Straw told the hearing how Conlan was jailed for 30 months in May 2004 for indecent assault of a child.

Then, in September 2008, Conlan was jailed for 33 months at Lincoln Crown Court for sexual activity with a child.

Finally, in November 2008, he was handed a 14-month consecutive term at Derby Crown Court for making indecent images of a child.

Michael Cranmer-Brown, for Conlan, said his client has completed all of the programmes designed to rehabilitate him.

He said: “One can clearly see the work that has been done has worked as he has stayed out of trouble since his last conviction in 2008.”
