Man given suspended sentence for child sex offences in south London
Christian Mosquera-Ortiz, 26 (26.11.92) of Lilford Road, SE5 appeared at Inner London Crown Court on Friday, 15 February where he was sentenced to 9 months imprisonment suspended for 18 months in connection with two counts of sexual activing with a child, contrary to section 9 (1) of the Sexual Offences Act 2003.
He is required to complete a Horizon programme for 29 days, for men over 18 who have been assessed as medium risk and have been convicted of a sexual offence.
He was also ordered to complete a Rehabilitation Activity Requirement (RAR) for up to 60 days and notification requirement for a period of 10 years. He was prohibited from working with children or adults with special needs and given a Sexual Harm Prevention Order (SHPO). He was also given a restraining order and ordered to pay costs.
The offences relate to a report police received from a third party on Friday, 19 October 2018 which alleged Mosquera-Ortiz had been engaging a 14-year-old girl in sexual activity.
An investigation by detectives from the Central South (Lambeth and Southwark) Criminal Investigations Department, identified the victim who was then contacted by police and supported by specialist officers.
The offences against the child took place between September 2017 and October 2018.
Mosquera-Ortiz was arrested on Saturday, 20 October and was charged the following day with:
Sexual Activity with a Child, contrary to section 9(1) of the Sexual Offences Act 2003;
Sexual Activity with a Child, contrary to section 9(1) of the Sexual Offences Act 2003
Intentionally causing or inciting a child to engage in a sexual activity, contrary to section 10(1) of the Sexual Offences Act 2003
Meeting a child following sexual grooming contrary to section 15(1) of the Sexual Offences Act 2003.Causing or Inciting a Child to engage in Sexual Activity, cont. to s.10(1) of the Sexual Offences Act 2003.
At Inner London Crown Court on Friday, 18 January, Mosquera-Ortiz pleaded guilty to counts 1 and 2. His plea was accepted by the Crown Prosecution Service [CPS] and counts 3 and 4 will lie on file.
Mosqiera-Ortiz is now also subject to sexual harm prevention order for 10 years:
The defendant is prohibited from:
1) Having any unsupervised contact of any kind with any child under the age of 16, other than;
(a) Such as is inadvertent and not reasonably avoidable in the course of lawful daily life, or,
(b) With the consent of the child’ parent or guardian, who has knowledge of his convictions.
2) From using computer or mobile phone capable of accessing the internet which does not have the capability to retain and display the history of internet use.
3) From making any attempt to delete such history or use program or device capable of deleting that history
5) Must permit police officers to inspect the equipment or device.
