Man who had sex with 13-year-old spared jail

Paul Strath, 19, was caught having sex with an underage girl in an Aberdeen nursery.

A man caught having sex with an underage girl in a nursery has escaped jail.

Paul Strath, 19, sneaked into the infants’ school with a 13-year-old girl after chatting to her online.

But he was caught in the act by passing police officers who were called to the scene by a suspicious neighbour.

The teenager was arrested and later admitted having unlawful sex with a minor when he appeared in court.

On Monday he was ordered to carry out 18 months of probation in the hope it would sort out his behaviour towards younger girls.

The court heard that the sex was consensual and that Strath claimed the girl had told him she was 15.

Aberdeen Sheriff Court heard the pair had known each other for a year and had been chatting on social networking site Bebo.

The pair began texting each other for a few weeks then decided to meet up for sex at Byron Park Infant School yards from his Northfield home on October 18.

The shamed teenager said he had shouted at the girl when she admitted her age and said he was ashamed because he was now being branded a paedophile.

Strath said: “She had been texting me asking to meet up for a few weeks. It was only when the police asked us our ages I found out she was 13.

“I was absolutely gutted. I just ran away from the police but they caught me and put me in the police car. I feel like my whole life has been ruined.”

Strath admitted having sex with a minor and his not guilty plea to breaching the peace was accepted by the Crown.

Jobless Strath was ordered to carry out probation and also put on the sex offenders register for 18 months.

Sheriff Edward Savage told him: “I’m told that you appreciate the serious nature of this type of offence.

“You have various issues you need to address. One is your alcohol consumption and your attitude towards younger girls.”
